Terms of Service
Last updated: 26 September 2026
1. Provider and acceptance
MoodSpark is provided by Ágota Téti, an Austrian sole trader (Einzelunternehmerin), Arsenalstraße 8/0305, 1100 Wien, Austria ("MoodSpark", "we", "us"). Contact us at hello@moodspark.today or +43 681 10681310.
By creating an account, using MoodSpark, or explicitly accepting these Terms before a purchase, you agree to these Terms and our Refund & Cancellation Policy. If you do not agree, do not use or purchase the service.
2. Eligibility and your account
You must have legal capacity to enter this agreement. If local law requires parental or guardian consent, you may use MoodSpark only with that consent. You must provide accurate account information, keep your sign-in details confidential, and promptly tell us if you believe your account has been misused. You are responsible for activity under your account unless applicable law provides otherwise.
3. The service
MoodSpark is a self-care and wellbeing product. It offers brief check-ins, suggestions for manageable activities, feedback-based personalisation, and a place to create personal rituals. Free registered accounts can make up to three terminal card resolutions per calendar day. Opening a card does not count. Trial and paid members have unlimited use, subject to these Terms and reasonable technical limits.
MoodSpark is not medical care, psychotherapy, crisis support, diagnosis, or medical advice. It is not a substitute for a qualified professional. Do not rely on it for an emergency or a decision requiring medical attention; contact local emergency services or an appropriate professional instead.
4. Plans, trial, renewal, and cancellation
- Founding annual: 14-day free trial, then €19 for the first annual billing period; it automatically renews at €44.99 per year unless cancelled before renewal.
- Regular annual: 14-day free trial, then €44.99 per year; it automatically renews yearly unless cancelled before renewal.
- Monthly: 14-day free trial, then €9.99 per month; it automatically renews monthly unless cancelled before renewal.
The price, billing interval, trial, and renewal terms shown immediately before checkout form part of your order. Paddle may display applicable tax or localised payment information. You can manage, switch eligible plans, or cancel through Account, which opens Paddle’s customer portal. Cancellation prevents future renewals and normally takes effect at the end of the current trial or paid billing period; it is not itself a refund. Access codes provide access for their stated duration and do not replace an existing paid or trial entitlement.
5. Paddle as Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
For purchases processed through Paddle, Paddle is the authorised reseller and seller of record. Paddle handles checkout, payment, tax, invoicing, order administration, eligible refunds, and payment-related buyer support under Paddle’s Buyer Terms (opens in a new tab). Our Refund & Cancellation Policy explains how to request help.
6. Acceptable use
You must not:
- use MoodSpark unlawfully, fraudulently, abusively, or to harm another person;
- submit malware, spam, unlawful content, or content that infringes another person’s rights;
- probe, disrupt, overload, bypass, scrape, or attempt unauthorised access to the service or another account;
- circumvent usage, access, payment, or security controls;
- reverse engineer the service except where applicable law expressly permits it;
- resell, sublicense, or redistribute MoodSpark or its content without written permission; or
- share an account in a way that allows multiple people to use one personal membership.
7. Your content
You retain rights in content you submit, including reflections, personal rituals, and collaborator material. You grant us a non-exclusive licence to host, process, reproduce, and display that content only as needed to operate, secure, and improve MoodSpark and, for collaborator submissions, to evaluate the proposed contribution. You confirm you have the rights needed to submit it. Do not submit unlawful material or confidential information belonging to someone else.
8. MoodSpark intellectual property
MoodSpark’s software, interface, branding, original activities, text, selection, arrangement, and related materials are owned by Ágota Téti or her licensors and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to use the service for your personal use in accordance with these Terms. No other rights are transferred.
9. Availability and changes
We may maintain, update, change, or discontinue parts of MoodSpark. We aim to provide a dependable service but do not promise uninterrupted, error-free, or permanently available access. Material changes affecting a paid service will be communicated where required by law. Suggestions depend on information you provide and may not fit every person or moment.
10. Suspension and termination
We may restrict, suspend, or terminate access where reasonably necessary for a material breach, non-payment, fraud or security risk, unlawful conduct, harm to the service or others, or compliance with law. Where appropriate, we will provide notice and a chance to remedy. You may stop using MoodSpark, cancel a subscription, and request account deletion. An active provider subscription must be cancelled before account deletion so continuing billing is not detached from your account.
11. Disclaimers and liability
Subject to mandatory consumer law, MoodSpark is provided “as is” and “as available,” and we do not guarantee a particular wellbeing outcome or that every suggestion will be suitable. To the extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for intent or gross negligence where applicable, or removes statutory warranty, refund, withdrawal, or other non-waivable consumer rights. Any limitation is interpreted only to the maximum extent permitted by applicable law.
12. Governing law and disputes
Austrian law governs these Terms, excluding conflict-of-law rules, but this choice does not deprive a consumer of mandatory protections available under the law of their habitual residence. Courts are determined by applicable law; no clause here requires a consumer to give up a mandatory right to bring proceedings in a competent court. Please contact us first so we can try to resolve a concern.
13. Changes and contact
We may revise these Terms for legal, security, or service changes. We will give reasonable notice of material changes where required. The version accepted for a purchase is recorded at checkout. Questions may be sent to hello@moodspark.today. See also our Privacy Policy, Refund & Cancellation Policy, and Imprint.
